Terms and Conditions for Affiliate Agent Referral Program
The following terms and conditions (“Agreement”) govern your participation in the Affiliate Agent Referral Program (“Program”) offered by Far Homes (“Company”). By participating in the Program, you agree to be bound by these terms and conditions.
1. Eligibility and Participation
To participate in the Program, you must be a licensed real estate agent operating in the United States or Canada. You must also be at least 18 years of age. By participating in the Program, you represent and warrant that you meet these eligibility requirements.
If you meet these eligibility criteria, you may apply to join the Program here. After applying, Far Homes will determine whether to accept your application to join the program. There is no guarantee of acceptance; Far Homes may deny your application to participate in the program for any reason.
2. Referral Process
As an American/Canadian agent, you may refer customers who are interested in buying a home in Mexico to Far Homes by providing the customer’s contact information through the designated referral form that is sent to you when you’re accepted in the program. The customer must be someone who has no previous relationship with Far Homes and whose information is not already present in Far Homes’ databases/CRM software. Far Homes will, at our sole discretion, qualify the referrals sent to us and use commercially reasonable efforts to match qualified customers with a real estate agent in Mexico.
Provided that the above conditions have been met, if the customer completes a transaction within 12 months of being referred by you Far Homes will pay you 30% of the commission revenue we receive from the agent in Mexico from that transaction.
3. No Guarantees
Far Homes makes no guarantees as to the likelihood of a referral resulting in a completed transaction. Far Homes is not responsible for any delays, errors or omissions in processing referrals or for any failure of a referred customer to complete a transaction.
4. Prohibited Conduct
You may not engage in any conduct that could damage the reputation or goodwill of Far Homes, including but not limited to spamming, unsolicited commercial emails, or false or misleading advertising. You may not make any representations or warranties on behalf of Far Homes, or represent yourself as an agent or representative of Far Homes.
5. Intellectual Property
Far Homes owns all right, title and interest in and to the Far Homes name and logo, and any other trademarks, service marks, trade names, logos or other proprietary designations used in connection with the Program (“Company IP”). You may not use the Company IP except as expressly authorized by Far Homes in writing.
6. Termination
Far Homes may terminate your participation in the Program at any time for any reason. If you violate any of these terms and conditions, Far Homes may terminate your participation in the Program and withhold any referral fees owed to you.
7. Limitation of Liability
Far Homes will not be liable to you for any indirect, consequential, punitive or incidental damages arising out of your participation in the Program, even if Far Homes has been advised of the possibility of such damages.
8. Governing Law and Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the federal or state courts located in King County, Washington.
10. Entire Agreement
This Agreement constitutes the entire agreement between you and Far Homes with respect to the Program and supersedes all prior or contemporaneous agreements or understandings, whether written or oral, relating to the Program.
By participating in the Program, you acknowledge that you have read, understand, and agree to be bound by these terms and conditions.
